The Website provides AI-based analysis of facial images to generate scores related to beauty, symmetry, and proportions. These outputs are generated using automated algorithms and are intended for informational, research, educational and personal use. The Services may include free and paid features.

3. User Eligibility

By using this Website, you confirm that you are at least 18 years old or above.

4. User Responsibilities

By using the Website, you agree to provide accurate information, maintain confidentiality of login credentials, accept responsibility for activities under your account, upload only images you have the right to use, and comply with all applicable laws.

You agree not to upload images of others without consent, use the Website for unlawful purposes, or attempt to reverse-engineer the AI system.

5. Image Upload

By uploading any image, you represent that you are the individual in the image or have obtained explicit consent from the individual, and the individual has consented to AI-based facial analysis and understands that a numerical beauty score will be generated. Do not upload images of minors or images taken without permission.

6. User Consent

By uploading a photograph, you consent to its processing for facial aesthetic analysis and storage of associated data for up to 2 years in accordance with the Privacy Policy. Processing, once completed, cannot be reversed.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information.

8. AI and Subjectivity Disclaimer

Results are generated by a fully automated AI system without human intervention. The assessment of beauty is based on a defined analytical framework incorporating structured proportional principles derived from original PhD research in Orthodontics. Results do not constitute medical, psychological, or professional advice and are intended for informational, educational, and research purposes only.

9. Data Usage, Storage, and International Users

By using the Website, you consent to the collection and use of information as described in the Privacy Policy. You are interacting with an artificial intelligence system. Results, including images, annotations, and scores, are generated and made available to the user for viewing and download. Once an image has been processed and results have been generated and shared, such processing cannot be reversed.

10. Payments and Refunds

Except where required by applicable law, all payments are final and non-refundable. Users are provided with a limited free trial to evaluate the Services. By purchasing any paid plan, you acknowledge satisfaction with the Services.

11. No Expectation or Satisfaction Guarantee

The Services are provided on an "as is" and "as available" basis. Results are generated through automated computational processes and may not align with subjective expectations. Dissatisfaction with results does not constitute grounds for refunds or claims, except where required by applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, BEAUME ANALYTICS OPC PRIVATE LIMITED shall not be liable for any direct, indirect, incidental, or consequential damages arising from use or inability to use the Services, reliance on AI-generated results, or decisions made based on AI-generated outputs. Use of the platform is at your own risk.

All intellectual property rights in the platform, including software, algorithms, analysis methods, scoring systems, visual outputs, overall design and content, and branding, are owned by or licensed to BEAUME ANALYTICS OPC PRIVATE LIMITED. Unauthorized use, reproduction, or distribution is strictly prohibited.

14. Public Use & Media Usage

Users may use results including images, annotations, and scores for lawful personal, academic, research, and informational purposes, and in public or media contexts such as social media, publications, or beauty contests. Such use must not imply that BEAUME ANALYTICS OPC PRIVATE LIMITED endorses or is officially associated with any contest, ranking, or outcome.

15. Indemnification

You agree to indemnify and hold harmless BEAUME ANALYTICS OPC PRIVATE LIMITED from any claims, damages, losses, liabilities, and expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

16. Termination

We reserve the right to suspend or terminate access to the Website without notice if these Terms are violated or misuse or unlawful activity is suspected.

17. Governing Law, Dispute Resolution, and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts located in Thiruvananthapuram, Kerala, India shall have exclusive jurisdiction. Disputes shall first be resolved through good faith negotiations within thirty (30) days, then by arbitration under the Arbitration and Conciliation Act, 1996, with seat at Thiruvananthapuram, Kerala, India.
